The change in the withholding rates applicable for payments comes into force today. In professional activity, the change in the case of fee invoices is relevant to us, which until now was 19% and now it is 15%. With less economic impact, but which must be taken into account, we have the withholdings on the rents subject to withholding, which until now was 20% and will be 19.50% until December. It is already predicted that it will go to 19% in first of next January.
Decree 67/2015 of May 5 has just been published, which is colloquially said to regulate the reviews of buildings, under the definition of Technical Inspection of Buildings. Until now, the revisions of the buildings were foreseen in Decree 187/2010, of November 23, which, in other words, has not had the expected real effect.
In 2012, following the collapse of a building in the center of Tarragona, it was found that only 4% of the buildings that should have passed the inspection had done so. Now a new regulation comes into force, which tries to achieve the objectives that the previous regulation did not achieve, incorporating the obligation to review single-family buildings, unless they have a certificate of occupancy that is still valid. It has also added the obligation to have the building book, which until now only affected New Works and Major renovations, for all constructions.
The deadlines for carrying out the inspections have been established with the following schedule:
Between 1951 and 1960: Until December 31, 2015
Between 1961 and 1971: Until December 31, 2016
From 1971: The year it turns 45 years old
Before 1900: Until December 31, 2016
Between 1901 and 1930: Until December 31, 2017
Between 1931 and 1950: Until December 31, 2018
Between 1951 and 1960: Until December 31, 2019
Between 1961 and 1975: Until December 31, 2020
From 1975: The year it turns 45 years old.
With a certain delay compared to the State Law, which was modified in 2013, the modification of the law has been published for Catalonia.
Beyond the fact that the new owner's responsibility for the property's debts has been extended, which in the case of Catalonia has been fixed in the four years prior to the date of acquisition, we would like to point out other aspects that we also consider relevant:
· The Community's debts to third parties have the status of common among the co-owners. Despite this condition of commonwealth, each co-owner is responsible for the Community's debts in proportion to his share.
· The departments of the Community are responsible for the debts corresponding to the current year and the four years prior to the time of transmission.
· The Certificates of being up to date with payment at the time of transmission must state the approved spills and still pending payment.
· The Vice Presidency is expressly regulated and it is foreseen that the Presidency can delegate its functions.
· The meetings are convened in a single call, eight days in advance. Although the call is planned by e-mail, the problems of accreditation of the notification remain. The ad remains on the counter.
· Only resolutions that were foreseen in the Agenda, including changes of President and Administrator, can be taken.
· For the validity of the agreements, it is necessary to have a double majority of Votes and Coefficients, both when a simple majority must be obtained, and for qualified majorities of 4/5 parts of the Community.
· The mechanism for the adoption of agreements that require a majority of 4/5 parts of the Community is as follows: At the time of voting at the Board, only the majority of votes and coefficients of those present and represented are required. Next, the absentees must be added, who are considered favorable to the agreement. It is at this point that the required majority has been reached. Once the thirty days have passed from the notification to the absentees, if the majority has not been lost, the agreement becomes definitively valid.
· When drawing up the minutes of the meeting, the results of the votes must be identified (the generic: "Approved by majority" is not valid).
· The deadline for demanding the restoration to the initial state of the modifications in the common elements that are notorious is four years.
· The transferor is obliged to notify the data of the new owner when the department is sold. If you don't, you are still responsible for paying the fees.
Once again, and now in its fourteenth edition, the University of Barcelona Master's in Real Estate Advice and Consultancy is held between October 2014 and June 2015, with the participation of Joan Ramón i Vidal, founding partner of Barnaquatre , as a speaker in the sessions intended to train students in the field of management of Communities of Owners, dealing with the Horizontal Property Law.
The students of this master's degree, made up of both people who want to complete their training and professionals who update and improve their skills, always become an opportunity for everyone, both the students and the speaker, by generating an exchange of opinions and new visions of management.

We inform you again that Joan Ramon i Vidal, founding partner of Barnaquatre, will once again be part of the teaching staff in the 3rd edition of the Master in Facility Management at the Sert School, which will be held between October 2013 and June of 2014.
The Sert School is the continuous training center through which the College of Architects of Catalonia (COAC) offers a systematic training and support program to the professional community.
The aim of the course is for the professional to acquire new management skills that will allow him to: Establish long-term cost-saving strategies in building management, analyze and manage the life cycle of the building's elements, plan the preventive and corrective maintenance of the building, acquire professional judgment when implementing smart technologies, effectively manage spaces and new locations, save energy costs in the building, decide with professional judgment when faced with an option of purchase or rent, effectively manage the outsourcing of services and correctly select the most suitable management software in Facility Management.
Barnaquatre contributes, since the 1st edition, by sharing its experience in the analysis of the scenarios that arise when managing the elements of a building, either from the perspective of the property or that of the user.
Once again, Joan Ramon i Vidal, founding partner of Barnaquatre, will be part of the teaching staff in the XIII edition of the Master's in Real Estate Advice and Consultancy at the University of Barcelona, which will be held between October 2013 and June 2014 .
The University of Barcelona, from the Faculty of Economics and Business, organizes a Master's course aimed at people interested in the world of real estate, with the aim of offering participants the main tools to conduct business in the field of management, investment and real estate development. The publication of Law 8/2013 of June 26 has come to adjust some aspects of the legislation that regulates Owner Communities. However, this text only affects buildings located outside Catalonia, since these are regulated by article 553 of Book Five of the Civil Code of Catalonia, without modification for now. It seems important to highlight that, since the entry into force of the Law, the responsibility of a new purchaser before the Community for the debts of the previous owner has been modified. Until now, it only reached the overdue part of the year of the acquisition and the previous year. From now on, this second section of liability has been extended to the three years prior to the date of acquisition. The reform responds to an obvious need to solve the lack of protection of Owners' Communities against delinquent owners. It is to be hoped that the Parliament of Catalonia will also modify this issue, which may not need to be postponed until the incorporation of other reforms that are certainly also interesting, but not as urgent as this one.
