An important amendment to the L.A.U. enters into force today, the main innovation of which is the reduction of the minimum mandatory period for the owner of the contract, which is currently five years, to three years. In addition, the lessee is allowed to terminate the contract from the sixth month of the lease. The last relevant feature is the freedom of agreements between the parties to establish the mechanism for revising the income each year, which was even mandatory, in the first five years, to adjust to the variations of the I.P.C.. The change is intended legislative flexibility and dynamism of a market, the housing rental market, which represents only 17 percent of the state's housing stock. It will be necessary to see if this improvement in the conditions for the owners, who are looking for the incorporation of new rental units on the market, does not penalize the potential tenants by seeing the terms for which they are guaranteed to stay in the rented property reduced.

The publication of Law 8/2013 of June 26, has incorporated the sanctioning regime for non-compliance with the obligation to the operators of the real estate sector, both individual owners or professionals, as well as intermediaries or marketers to incorporate in the offers (advertisements in any means) the Energy Efficiency Certification of Buildings. Everyone is responsible for complying with the regulations, this sanctioning regime affects anyone who intervenes in a transaction, even with the mere publication of a commercial advertisement, on the internet, in the newspaper or in the shop windows of a real estate agency.

In short, it is a requirement for the transaction of any property, be it housing, premises or industrial building, to hand over to the purchaser a Certificate indicating the level of Energy Efficiency of the property transferred. This document, issued by an architect or engineer qualified for this purpose, duly legalized before the administration, determines, through the analysis of its characteristics and its architectural elements, to what level it is efficient or not, affecting the energy consumption that will be required in its subsequent use.

The final objective pursued is to ensure that the buyer by purchase or rental incorporates the Energy Efficiency level of the property in the decision-making process, which will have a final cost in their future budget. In this way, it is intended that the operators are concerned about improving the energy of the products. In this way, the quality of the real estate stock will be improved, with a reduction in overall energy consumption and needs. Unfortunately, instead of looking for positive incentives in the way of giving aid to the actions that improve the current situation, the sanctioning regime has been chosen to achieve a goal, laudable without a doubt, but which burdens with new obligations and costs a sector that follows suffering a crisis and that there is a need for incentives and aid, not more expenses.

From tomorrow, September 1, the new VAT rates established by Royal Decree-Law 20/2012 of July 13, published in the BOE on July 14, 2012, will enter into force. With regard to the rental market and purchase/sale of real estate, this change will affect as follows:

Rentals without purchase option

a) Rental of homes

Home rentals to individuals maintain the rate of 0%, while rentals to legal entities/subjects liable for VAT, go from 18% to 21%.

b) Rental of parking spaces/storage rooms

In the case of car parks/storage rooms, the VAT rate goes from 18% to 21%. Car parks/storage rooms rented with homes (up to a maximum of 2 units), maintain the 0% rate, as long as the tenant is a natural person.

b) Rental of premises/buildings/lots

The VAT rate goes from 18% to 21%.

You can consult the VAT rate applicable depending on the type of property and tenant in the following table:

*If more than 2 parking/storage units are rented, the excess units should be considered as premises and VAT applied to them.

Rent with purchase option

In those cases where the VAT rate was 0%, this remains. In cases where it was 8%, it becomes 10%. The following table lists these cases and indicates the applicable VAT rate depending on the type of property, the tenant and the developer of the building:

Buy Sell

VAT for the acquisition of new homes will remain at 4% during 2012. However, from 2013, 10% will apply. Purchases/sales previously subject to 18%, mainly of parking lots, premises, warehouses and plots, now have a rate of 21%.
